What Is a DUI in Missouri?
A DUI, or driving under the influence, is an offense that occurs when an individual is arrested for operating a motor vehicle while under the influence of alcohol or drugs. This can be determined by a blood alcohol content (BAC) of .08% or more, the results of a chemical test, or the officer's perception that the individual was impaired when driving. It is important to note that Missouri has an implied consent law, which means that if you are arrested for a DUI, you must take a chemical test or your driver's license will be suspended for one year.
Penalties for a DUI
In Missouri, the penalties for a DUI depend on the driver's previous convictions, the number of convictions within a 10-year period, and the number of aggravating circumstances. If a driver is convicted of a first-offense DUI, they will face a fine of $300-$1,000, mandatory education or treatment, and up to 6 months in jail. If a driver is convicted of a second DUI within 10 years, their penalties will be increased and may include a jail sentence of up to one year, fines of up to $1,000, mandatory treatment or education, and a driver's license suspension of up to one year.
Aggravating Circumstances
The penalties for a DUI can be increased if the individual is operating a commercial vehicle, if they have a BAC of .15% or more, if there is a minor under the age of 15 in the vehicle, or if there is a minor under the age of 15 who is injured or endangered by the driver's actions. The penalties for a DUI can also be increased if the driver is operating a school bus, a vehicle that transports hazardous materials, or a vehicle that is used to transport passengers for hire.
